Terms and Conditions (“Terms”)

Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the www.whippit.net.au website and the Whippit Delivery mobile application (the “Service”) operated by Whippit Pty Ltd (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Purchases

If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your name, bank details, address, age and in the situation involving alcohol – your identification.

Whippit Pty Ltd does not manufacture nor supply products delivered by the App but provides a third party delivery service. Whippit Pty Ltd does not accept responsibility for overall product quality – particularly in relation to purchases of “Food Products”. Although the service may accept possible circumstances of damage during delivery.

Alcohol

Whippit Pty Ltd does not manufacture nor supply alcohol but provides a third party delivery service.

Alcohol purchases are governed by the state laws in which alcohol is purchased and ordered.
The sale and supply of alcohol in Western Australia is governed by the Liquor Control Act 1988

Alcohol will not be supplied without a valid ID displayed upon receipt and provided with Order.

Alcohol purchases must be signed for upon delivery.

All Drivers delivering alcohol will maintain current Responsible Drinking of Alcohol certificates and/or same same certificates as per jurisdiction and provide alcohol within the structure of these rules.

Whippit Pty Ltd and its “drivers” reserve the right to cancel an order and refuse conditions if these requirements are not met. Whippit Pty Ltd reserve the right to “invoice/bill” purchaser costs associated with refused deliveries.

Tobacco Products

Tobacco purchases are governed by the state laws in which Tobacco is purchased and ordered.
The sale and supply of tobacco products and smoking implements in Western Australia is governed by Tobacco Products Control Act 2006

Under the Act, it is illegal for a person or a licence holder to sell or supply a tobacco product or smoking implement to a child, a person under the age of 18 years.
If you are caught selling tobacco products or smoking implements to a child, you and/or the licence holder may be issued with an ‘On the Spot’ fine of $1,000 or you may be prosecuted. The penalty for the sale or supply of tobacco products or smoking implements to a child is a maximum of $10,000 per offence for an individual and up to $40,000 per offence for a business.

Tobacco will not be supplied without a valid ID displayed upon receipt and provided with Order.

Subscriptions

In the event that purchases of a subscription nature become available: Service is to billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring fortnightly basis.

Content

Our Service allows you to post, link, share and otherwise make available certain information, text, graphics, videos, or other material pertaining to menu items(“Content”).

Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by Whippit Pty Ltd – particularly those of an online retail and hospitality nature.

Whippit Pty Ltd has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Whippit Pty Ltd shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Drivers

Whippit Pty Ltd views drivers as an important asset and seeks to ensure their well being. Abuse of drivers, particularly those delivery products to situations that include alcohol will result in a ban and possible prosecution.

CoronaVirus

Drivers may, at the request of customers leave purchased product in a safe place as indicated. This however, will not extend to Alcohol purchases, however social distance will be maintained where possible. In the advent of circumstances resulting in theft or damage from this request Whippit Pty Ltd will not accept liability.
